Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Carzona platform (carzona.com.py), operated by Airosofts LLC, located in Lexington, KY, United States (hereinafter, "Carzona", "we", or "our").

By creating an account, publishing a listing, or using any functionality of the Platform, you agree to these Terms in their entirety. If you do not agree, do not use the Platform.

2. Description of Services

Carzona is a vehicle marketplace that connects buyers and sellers in Paraguay. We offer:

  • For users: vehicle search and browsing, individual listing publication, favorites, direct contact with sellers via WhatsApp, phone, or email.
  • For dealers: subscription plans with inventory management, analytics dashboard, CRM system for lead management, dealer profile page, and featured listings.

Carzona is not a party to any vehicle purchase or sale transaction. We act solely as a technology intermediary that facilitates contact between parties. We do not inspect, guarantee, or verify the condition, legality, or existence of listed vehicles.

3. Ownership of Content and Data

All content, materials, information, vehicle data, listings, pricing, analytics, text, graphics, images, videos, software, and other materials made available on or through the Platform (collectively, "Carzona Content") are owned by or licensed to Airosofts LLC and are protected by applicable intellectual property and proprietary rights laws.

Carzona Content may not be used publicly or commercially without consent. You may not copy, reproduce, publish, display, distribute, scrape, sell, license, or otherwise use Carzona Content — including vehicle or market data — for any public, commercial, or third-party purpose without prior express written approval from Carzona.

4. Limited Permission to Use

Carzona grants you a limited, revocable, non-exclusive, non-transferable permission to access and use the Platform and Services solely for their intended purpose. All rights not expressly granted are reserved by Carzona.

5. Registration and Accounts

  • Information you provide must be truthful, complete, and up to date.
  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • You may register with email/password or through Google or Facebook.
  • We reserve the right to suspend or delete accounts that violate these Terms.

6. Vehicle Listings

By listing a vehicle on the Platform, you represent and warrant that:

  • You are the legitimate owner of the vehicle or have authorization to sell it.
  • The listing information (make, model, year, mileage, price, photos, condition) is truthful and accurate.
  • Published photos are of the actual vehicle and do not contain misleading, offensive, or illegal content.
  • The vehicle complies with all applicable laws and regulations in Paraguay.

We reserve the right to remove any listing that we consider fraudulent, misleading, or in violation of these Terms, without prior notice.

7. User Content

By uploading content to the Platform (photos, descriptions, vehicle data), you retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute such content in connection with the operation of the Platform.

This license terminates when you delete your content or your account, unless the content has been shared with other users who have not deleted it.

8. Dealer Subscription Plans

Dealers may access premium features through paid subscription plans. Plan details, pricing, and features are available on the Platform and may change over time.

  • Billing: subscriptions are billed monthly. Prices are listed in Paraguayan Guaraníes (Gs.).
  • Cancellation: you may cancel your subscription at any time. Access continues until the end of the billed period.
  • Price changes: we reserve the right to modify plan prices with 30 days prior notice.

9. Prohibited Conduct

By using the Platform, you agree not to:

  • Publish false, misleading, or fraudulent information about vehicles.
  • List stolen vehicles or vehicles with irregular documentation.
  • Use the Platform for illegal activities, including money laundering or fraud.
  • Scrape, harvest, mine, or extract data from the Platform by any means.
  • Attempt unauthorized access to other users' accounts or Platform systems.
  • Reverse engineer, interfere with, or disrupt the Platform or Services.
  • Send spam or unsolicited communications to other users.
  • Misrepresent your identity or impersonate any person or entity.

10. Disclaimers and Limitation of Liability

THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CARZONA DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

  • We do not guarantee the accuracy, completeness, or reliability of listings published by users or dealers.
  • We are not responsible for transactions between buyers and sellers, including disputes over vehicle condition, price, or legality.
  • We do not guarantee that the Platform will be free from errors, interruptions, or security vulnerabilities.
  • Our total liability shall in no event exceed the amount you have paid us in the 12 months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Airosofts LLC, its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Content you publish on the Platform.

12. Legal and Financial Consequences

Unauthorized use of Carzona Content or violation of these Terms may result in legal and financial penalties, including injunctive relief, monetary damages, recovery of attorneys' fees and costs, and other remedies available under law.

13. Suspension, Blocking, and Termination

Carzona may, at its sole discretion and without notice, block, suspend, restrict, or terminate your access to the Platform for any violation of these Terms or misuse of the Platform.

You may delete your account at any time from your profile settings. Account deletion is permanent and irreversible.

14. Governing Law

These Terms are governed by the laws of the State of Kentucky, United States. Any disputes shall be brought exclusively in the state or federal courts located in Kentucky.

For users residing in Paraguay, this does not affect rights under local consumer protection legislation that cannot be excluded by contract.

15. Dispute Resolution

Before initiating any legal action, both parties agree to attempt to resolve the dispute in good faith through direct negotiation for a period of 30 days, by sending written notice to the other party.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Changes to These Terms

Carzona may update these Terms at any time by posting revised Terms on the Platform. Continued use of the Platform after changes constitutes your acceptance of the updated Terms.
